1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Trading Daybook ("we," "us," or "our"), governing your access to and use of the Trading Daybook website and mobile application (collectively, the "Service").

By creating an account or using the Service, you confirm that you are at least 18 years of age and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

Trading Daybook is a web-based trading journal that allows traders to manually track their daily P&L, journal individual trades, monitor account performance, and analyze their trading history across multiple accounts. No broker connections are required — all data is entered manually by the user.

The Service is provided for personal use only. Trading Daybook is a journaling and tracking tool and does not provide financial advice, investment recommendations, or brokerage services. Any trading decisions you make are entirely your own responsibility.

3. User Accounts

To use the Service, you must create an account by providing a valid email address and password. You are responsible for:

You may not share your account with others or create multiple accounts for the same person. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

Trading Daybook offers the following subscription plans:

All subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis.

Payments are processed securely by Stripe. We accept Visa, Mastercard, American Express, and Discover. All payments are in US Dollars (USD).

You can manage your subscription, update your payment method, or cancel at any time through the billing portal accessible from your account Settings.

5. Free Trial

New users receive a 7-day free trial with full access to the Service. No credit card is required to start a trial.

At the end of the free trial period, your account will not be automatically charged. Access to the Service will be suspended until you upgrade to a paid subscription. Your data will be retained for 30 days after trial expiration. If you do not subscribe within 30 days, your data may be permanently deleted.

6. Cancellation and Refunds

You may cancel your subscription at any time through the billing portal in your account Settings or by contacting us at [email protected].

Upon cancellation, you will retain access to the Service until the end of your current billing period. After that, your account will be downgraded and access to paid features will be suspended.

Refund Policy: All payments are non-refundable. We do not offer refunds or credits for partial subscription periods, unused time, or any other reason. If you believe you have been charged in error, please contact us at [email protected] within 7 days of the charge.

The Service and its original content, features, and functionality — including but not limited to the Trading Daybook name, logo, design, software, and text — are and will remain the exclusive property of Trading Daybook and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use in accordance with these Terms.

9. Your Data

You retain full ownership of all trading data, journal entries, and other content you enter into the Service ("Your Data"). By using the Service, you grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you.

We do not sell Your Data to third parties. We do not use Your Data for advertising purposes. Your Data is stored securely using Supabase infrastructure.

Upon account deletion or data deletion request, we will permanently delete Your Data from our systems within a reasonable timeframe, except where retention is required by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Trading Daybook is a journaling tool only. We do not provide financial advice, investment advice, or trading recommendations. Any trading decisions made based on information entered into or derived from the Service are made at your own risk. We are not responsible for any financial losses you may incur.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADING DAYBOOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).

YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

12. Dispute Resolution

Informal Negotiations

Before initiating any formal dispute, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. Both parties agree to negotiate in good faith for at least 30 days before proceeding to arbitration.

Binding Arbitration

If informal negotiations fail, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in Union County, North Carolina, United States, rather than in court, except that you may assert claims in small claims court if your claims qualify.

We will pay arbitration fees if they are deemed excessive relative to the amount in dispute.

Litigation

If a dispute proceeds in court rather than arbitration, both parties agree that any litigation shall take place in Union County, North Carolina, United States, and you consent to the personal jurisdiction of courts located there.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of North Carolina, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email at the address associated with your account from [email protected].

Your continued use of the Service after any changes take effect constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
